Self Start Terms

These Self Start Terms (the "Self Start Terms") govern the one-off Self Start setup service. They form a binding agreement between the Service Provider and the Client.

These Self Start Terms cover the Self Start option only. If the Client took Start With Us, the one-off service is covered by the Strategy and Setup Terms instead. Everything beyond the one-off setup - the subscription, the B2B Outreach System, Leads, and all other terms - is governed by the Terms and Conditions in both cases.

The Client accepts these Self Start Terms before any payment is made. Acceptance is given in writing - by confirming acceptance in the form or checkout Bamya Leads provides, or by confirming acceptance by email - and in accepting them the Client confirms that it has read, understood, and agrees to these Self Start Terms and to the Terms and Conditions. The "Effective Date" is the date of that acceptance. Bamya Leads records the date of acceptance and the version accepted, and sends the Client a copy of the accepted version by email after acceptance, so that both Parties hold the same written record of what was agreed and when.

If the Self Start Fee is paid without acceptance having been recorded, payment of the fee is itself acceptance of these Self Start Terms and of the Terms and Conditions as published on the date of payment.

1. Parties

The Service Provider is ATTN PLEASE LTD, a company registered in England and Wales under company number 16665743, with registered address at 3rd Floor, 86-90 Paul Street, London, England, EC2A 4NE, with designated contact email yana@bamya.co (the "Service Provider" or "Bamya Leads"). The "Client" is the business identified in the order, questionnaire, or account through which the Self Start service is purchased, acting through the individual who accepts these Self Start Terms on its behalf. That individual confirms, in accepting them, that they are authorised to do so.

ATTN PLEASE LTD trades under the brand name "Bamya Leads". References in these Self Start Terms to "Bamya Leads" mean ATTN PLEASE LTD acting under that trading name.

The Service Provider and the Client are each a "Party" and together the "Parties".

2. The Self Start Service

Self Start is the one-off setup for a Client that already knows its offer and its audience. It is bought together with the subscription: the setup delivers into the B2B Outreach System, and the Client needs an active subscription for there to be anything to deliver into.

What the Client provides

  • The Client completes the questionnaire Bamya Leads provides, setting out its offer and the audience it wants to reach.
  • Positioning, audience and approach are the Client's own work. Bamya Leads does not carry out positioning work, audience definition, or strategy work under these Self Start Terms, and does not assess whether the Client's offer or audience is well chosen. That is what Start With Us is for.
  • Bamya Leads works from what the questionnaire contains. Where it is incomplete, the timescale below does not begin to run until the missing information is provided.

What Bamya Leads delivers

  • The outreach messages for the Client's first campaign, written from the questionnaire.
  • That campaign set up and ready to use on the B2B Outreach System.
  • Setup covers one campaign. Further campaigns are ordered separately under the Terms and Conditions.
  • There is no strategy call, strategy session, or written strategy under Self Start, and no round of review before the campaign is set up. Once it is set up, the Client can adjust the messages itself on the B2B Outreach System at any time.

Timing

  • Bamya Leads aims to deliver the messages and complete the setup within 5 business days of the later of (a) the Self Start Fee being received in cleared funds and (b) the Client submitting a complete questionnaire. This is a target rather than a guaranteed date.

Where the messages can be used

  • The messages are prepared for the Client's use inside the B2B Outreach System and are delivered into it. The licence to use them does not extend to use outside the B2B Outreach System, and they remain usable for as long as the Client has access to it under Section 5 of the Terms and Conditions.
  • The Permitted Use and Restrictions on Deliverables provisions in Section 6 of the Terms and Conditions apply to the messages as deliverables.

3. Fee and Payment

All amounts are in GBP.

  • The Self Start Fee is the one-off Self Start fee set out in the applicable order or invoice or, where the order does not state an amount, the price published at leads.bamya.co/pricing at the time of the order. It is payable after the Client has accepted these Self Start Terms and before Bamya Leads begins the setup.
  • The discovery call is free and takes place before any payment is made.
  • Bamya Leads is not registered for VAT. No VAT is charged on the Self Start Fee and Bamya Leads does not issue VAT invoices.
  • Bamya Leads is under no obligation to begin the setup until the Self Start Fee is received in cleared funds. No delivery timeline begins to run before that point.
  • The Self Start Fee is refundable in full if Bamya Leads has not begun the work. Once that work has begun, the fee is not refundable, because it is paid for work carried out once and specifically for the Client.

If the questionnaire is not returned

  • Where the Self Start Fee has been paid but no complete questionnaire has been received, Bamya Leads will remind the Client in writing.
  • If a complete questionnaire has still not been received 90 calendar days after payment, the order lapses, Bamya Leads is released from any obligation to deliver it, and the Self Start Fee is not refundable. Bamya Leads may agree in writing to extend that period or to reinstate a lapsed order.

4. Relationship to the Terms and Conditions

These Self Start Terms cover the one-off Self Start service and fee only. Everything else governing the relationship between the Parties is set out in Bamya Leads's Terms and Conditions, including the subscription and ongoing use of the B2B Outreach System, the supply of Researched Leads, Personal Leads and Potential Lead lists and their pricing, Lead quality standards, Client obligations, confidentiality, data protection, publicity and brand use, limitation of liability, term and termination, and governing law and disputes.

By accepting these Self Start Terms, the Client confirms that it has read and accepts the Terms and Conditions as published at the Effective Date, which are incorporated into and form part of these Self Start Terms. Where these Self Start Terms and the Terms and Conditions differ on the Self Start service specifically, these Self Start Terms govern; on every other matter the Terms and Conditions govern.

These Self Start Terms are governed by the laws of England and Wales, and the dispute provisions in Section 12 of the Terms and Conditions apply to them.

5. Changes to these Self Start Terms and Contact

We may update these Self Start Terms from time to time. The date at the top of this page shows when they were last revised. Material changes will be reflected in an updated version published at the same web address. The version that governs is the one in force at the date the Client accepts them; a later change does not alter what was accepted for a Self Start service already ordered.
